1. Agreement and provider
These terms govern your use of NORDR, a native iOS surf-information application distributed through the Apple App Store and provided by PelagicLabs, Belgium, VAT / enterprise number BE1032.515.015. By downloading, creating an account, purchasing access, or using the app, you agree to these terms and the applicable Apple App Store rules. If you do not agree, do not use NORDR.
Mandatory consumer rights in your country continue to apply and are not excluded by these terms.
2. Accounts and eligibility
NORDR can support guest access and optional Firebase accounts using email and password, Google Sign-In, or Sign in with Apple. You are responsible for keeping access to your device and account secure and for information submitted through your account. Notify us promptly if you reasonably believe the account is being misused.
You must be legally capable of agreeing to these terms. A child who cannot enter an online-service agreement independently under applicable law may use NORDR only with the involvement and authorisation of a parent or guardian.
3. Licence
NORDR is licensed, not sold. Subject to these terms and the relevant store licence, PelagicLabs grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on supported devices for lawful, non-commercial surf planning and related personal use.
You may not copy, sell, rent, redistribute, reverse engineer, bypass technical protections, extract datasets, use automated scraping, or create a competing service from NORDR except where applicable law expressly permits an activity that cannot be restricted by contract.
4. Safety and forecast limitations
NORDR is an information and planning tool. It is not a safety device, emergency service, navigation aid, lifeguard, coast-guard warning system, or substitute for your own judgement.
Surf forecasts, ratings, alerts, written calls, buoy observations, tide values, weather models, nearshore calculations, and machine-learning or rules-based outputs are estimates. They can be incomplete, delayed, stale, unavailable, or wrong. Conditions can change rapidly and differ from the displayed information because of local bathymetry, currents, wind, tide, crowds, obstacles, pollution, access rules, equipment, and model uncertainty.
Before entering the water, check actual conditions, official marine and weather warnings, local access information, lifeguard or rescue advice, and your own fitness, equipment, experience, and limits. Never rely on a notification or score as proof that a session is safe. Call the appropriate emergency service in an emergency.
5. App features and availability
Features can include forecasts, maps, spots, custom-spot tuning and sharing, journals, board or Quiver recommendations, alerts, reliability information, data sources, and paid planning tools. Feature availability can vary by platform, country, spot, subscription, app version, provider coverage, and rollout status.
PelagicLabs may improve, replace, suspend, or retire a feature where reasonably necessary for safety, legality, provider changes, technical maintenance, abuse prevention, or product development. We will provide proportionate notice where a material change affects a paid digital service and applicable consumer law requires notice or another remedy.
6. Custom spots, sharing, and user content
You retain ownership of spot names, tuning, journal entries, and other original content you create. You grant PelagicLabs a limited licence to host, transmit, validate, display, and process that content only as needed to provide the feature, maintain security, and comply with law.
A custom-spot share link can contain a spot name, precise coordinates, break settings, and tuning information. Anyone who receives the link may be able to access or forward it. Do not share private property, restricted access, confidential locations, personal data belonging to someone else, or content you do not have the right to disclose. You are responsible for the audience and consequences of a link you create.
We may remove or disable unlawful, infringing, dangerous, abusive, technically harmful, or misleading shared content, or content that exposes another person's private information without a lawful basis.
7. Free and paid access
NORDR can provide free features and optional paid access. Available products, included features, billing periods, prices, currencies, taxes, trial eligibility, family-sharing status, and promotional terms are displayed in the app and the relevant store purchase sheet before confirmation. Store information shown at the point of purchase controls if it conflicts with an older marketing description.
Depending on availability, products can include:
- a monthly auto-renewing subscription;
- an annual auto-renewing subscription, potentially with a trial;
- a crew or family-oriented subscription where store family sharing is supported;
- a one-time lifetime or founder purchase.
RevenueCat is used to retrieve offerings and determine entitlement state. The Apple App Store processes payment. PelagicLabs does not receive your complete payment-card details.
8. Renewal, cancellation, restoration, and refunds
An auto-renewing subscription continues for successive billing periods unless it is cancelled through the Apple App Store before the renewal deadline shown by Apple. The Apple account may be charged shortly before or at the start of the next period according to Apple's rules. Cancelling normally stops future renewal while preserving access through the paid period.
- Apple: manage the subscription in Apple Account settings or the App Store subscription-management interface.
- Restore: use the in-app restore function with the relevant Apple account where available.
Uninstalling NORDR, signing out, or deleting the NORDR account does not cancel a store subscription. Refund requests and billing disputes are normally handled by the store that processed payment, subject to applicable law. Nothing in these terms removes statutory refund, conformity, termination, repair, price-reduction, or withdrawal rights that cannot lawfully be excluded.
Where immediate supply of digital content or a digital service affects a statutory withdrawal period, the store purchase flow may request the consent and acknowledgement required by applicable consumer law. The exact consequence depends on the product, performance already supplied, store process, and law of your country.
9. Acceptable use
You must not:
- use NORDR for unlawful access, trespass, harassment, fraud, or unsafe instructions;
- interfere with the app, backend, providers, alerts, authentication, or purchases;
- circumvent subscription or entitlement controls;
- submit malware, excessive automated traffic, scraping, denial-of-service traffic, or manipulated requests;
- misrepresent NORDR forecasts as official safety warnings or guaranteed observations;
- infringe intellectual-property, privacy, database, or other rights;
- use a shared link to expose another person's confidential or precise location without authority.
10. Third-party services and data
NORDR depends on Apple, Google, Firebase, RevenueCat, hosting providers, maps, environmental and marine datasets, weather and tide providers, push services, and other upstream sources. Their availability, licences, terms, and data can change. Third-party content remains subject to the provider's rights and disclaimers.
A reference to a provider does not mean it endorses NORDR. PelagicLabs remains responsible for its own contractual obligations but cannot promise uninterrupted operation of an independent provider.
11. Intellectual property
NORDR's software, design, branding, original text, scoring presentation, configuration, and proprietary content belong to PelagicLabs or its licensors. Public, institutional, and commercial environmental data remains subject to the source's applicable licence and attribution requirements.
12. Suspension and termination
You may stop using the app at any time and may delete an account through the app. PelagicLabs may restrict or suspend access where reasonably necessary for a serious or repeated breach, security risk, payment or entitlement fraud, unlawful conduct, provider requirement, or protection of other users. Where appropriate, we will give notice and an opportunity to remedy.
Termination does not cancel amounts already lawfully due, remove store subscription management requirements, or affect provisions that by nature continue, including intellectual property, legal claims, and mandatory consumer rights.
13. Conformity, warranties, and liability
PelagicLabs will provide paid digital services with the conformity and remedies required by applicable consumer law. Outside those mandatory obligations, NORDR is provided with the availability and uncertainty inherent in forecast, sensor, network, and third-party data services.
To the maximum extent permitted by law, PelagicLabs is not responsible for losses caused by relying on NORDR as a safety guarantee, ignoring official warnings, entering conditions beyond your ability, unlawful access, inaccurate user-submitted content, or a third-party outage beyond reasonable control. PelagicLabs does not exclude liability that cannot legally be excluded, including liability for fraud, deliberate misconduct, death or personal injury caused by negligence where such an exclusion is prohibited, or mandatory consumer remedies.
14. Privacy
The NORDR Privacy Policy explains accounts, location, forecasts, local storage, purchases, notifications, sharing, recipients, international transfers, retention, and data-subject rights.
15. Governing law and disputes
These terms are governed by Belgian law. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you habitually reside. Courts in Belgium have jurisdiction unless mandatory consumer law permits or requires proceedings in another competent court, including a court in your country of residence.
Please contact us first so we can attempt to resolve a concern directly. You may also use any consumer mediation, enforcement body, or court available under applicable national or EU law.
16. Changes
We may update these terms for legal, security, provider, platform, or product reasons. The date above identifies the current version. Where a material change to an ongoing paid digital service requires advance notice, consent, or a termination right under applicable law, we will provide the required process.
