Terms of Use for AEGIR

Last updated: 24 September 2026
Effective date: 24 September 2026

See the AEGIR Privacy Policy for data handling.

1. Agreement and provider

These terms govern your use of AEGIR, a mobile app for planning coastal dives, provided by PelagicLabs, Belgium, VAT / enterprise number BE1032.515.015. By downloading, signing in, buying access, or using the app, you agree to these terms and to the rules of the app store you got it from. If you do not agree, do not use AEGIR.

Mandatory consumer rights in your country still apply and are not excluded by these terms.

2. Diving limits and your responsibility

AEGIR is a planning aid. It is not a safety system, dive computer, decompression planner, navigation aid, emergency service, or substitute for training, a buddy, local advice, or your own judgement.

Briefings, scores, time windows, visibility, current, slack, tide, swell, wind, temperature, bathymetry, buoy readings, and alerts are advisory. They interpret available data and can be incomplete, late, stale, unavailable, or wrong. Conditions at a site can change fast and differ from what the app shows. A good score or window does not mean a site is safe. Cached and offline data can be out of date.

You decide whether to enter the water, and you are responsible for that decision. Before a dive, check actual conditions at the site, official marine and weather warnings, local rules and access, and your own fitness, training, certification, equipment, and limits. Dive within your training. In an emergency, call the local emergency service.

Regulation references point to the official source. They are not legal advice and do not authorise entry, fishing, or taking any species. Confirm current local rules yourself.

3. Fish ID and species information

Fish ID results are possible matches from a photo model, for comparison against the species cues in the app. They are not a confirmed identification. Do not rely on them to decide whether a fish is safe to handle or eat, legal to take, or protected. Species and season information is advisory.

4. Accounts and eligibility

An account is optional. AEGIR supports Sign in with Apple and Google Sign-In through Firebase. Keep your device and account secure, and tell us if you think your account is being misused. You can delete your account in the app.

You must be legally able to agree to these terms. A child who cannot enter an online-service agreement alone under their local law may use AEGIR only with the involvement and permission of a parent or guardian.

5. Licence

AEGIR is licensed, not sold. Subject to these terms and the store licence, PelagicLabs grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on supported devices for lawful, non-commercial dive planning and related personal use.

You may not copy, sell, rent, redistribute, reverse engineer, bypass technical protections, extract datasets, scrape, or build a competing service from AEGIR, except where the law allows it and it cannot be restricted by contract.

6. Features and availability

Features can include site briefings, forecasts, maps, bathymetry, buoy readings, saved sites, a logbook, alerts, Fish ID, species reference, offline regions, and paid planning tools. What is available can vary by platform, region, site, subscription, app version, and data coverage.

PelagicLabs may change, replace, suspend, or retire a feature where reasonably needed for safety, legal reasons, provider changes, maintenance, abuse prevention, or product development. Where a material change affects a paid digital service and the law requires notice or another remedy, we will provide it.

7. Your content

Your logbook entries, notes, saved sites, and alert rules stay on your device and remain yours. If you opt in to share a Fish ID photo for training, you give PelagicLabs a licence to store and use that photo and label to improve fish identification. You can ask us to delete them at any time.

Only submit photos you have the right to share. Do not submit photos that show other people's personal data without a lawful basis.

8. Free and paid access

AEGIR has free features and optional paid Pro access. Pro unlocks more data and tools, such as the hourly window scan with a 48-hour horizon, custom alerts, and offline regions. Pro does not make forecasts more accurate or sites safer, and it does not change a briefing, score, or window.

Products, prices, billing periods, taxes, trials, and promotional terms are shown in the app and on the store purchase sheet before you confirm. The store information at the point of purchase applies. Depending on availability, products can include auto-renewing subscriptions and a one-time lifetime purchase.

RevenueCat is used to show offers and check Pro access. Apple or Google processes the payment. PelagicLabs does not receive your card details.

9. Renewal, cancellation, restoration, and refunds

A subscription renews automatically at the price shown unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours before the period ends. A free trial, when offered, becomes a paid subscription at its end unless you cancel at least 24 hours before. Cancelling stops future renewals and keeps access until the end of the paid period. A lifetime purchase is a single payment and does not renew.

  • Apple: manage or cancel in your Apple Account subscription settings.
  • Google: manage or cancel in Google Play under Payments and subscriptions.
  • Restore: use Restore purchases in the app with the same store account.

Uninstalling AEGIR, signing out, or deleting your account does not cancel a subscription. Refunds and billing disputes are handled by the store that took the payment, subject to the law. Nothing in these terms removes statutory refund, conformity, termination, repair, price-reduction, or withdrawal rights that cannot lawfully be excluded.

Where immediate access to digital content or a digital service affects a statutory withdrawal period, the store may ask for the consent and acknowledgement that consumer law requires. The effect depends on the product, the store, and the law of your country.

10. Acceptable use

You must not:

  • use AEGIR for unlawful access, trespass, harassment, fraud, or unlawful fishing;
  • interfere with the app, backends, providers, sign-in, or purchases;
  • get around subscription or entitlement controls;
  • send malware, excessive automated traffic, scraping, denial-of-service traffic, or manipulated requests;
  • present AEGIR output as an official safety warning or a verified observation;
  • infringe intellectual-property, privacy, database, or other rights.

11. Third-party services and data attribution

AEGIR depends on Apple, Google, Firebase, RevenueCat, hosting providers, and marine, weather, and seabed data providers. Their availability, licences, and data can change, and their content stays subject to their own rights and disclaimers.

AEGIR uses data from sources including:

  • E.U. Copernicus Marine Service Information
  • MET Norway (Norwegian Meteorological Institute)
  • Open-Meteo
  • EMODnet (European Marine Observation and Data Network)
  • Sunrise-Sunset.org

Other sources are credited in the app where their data is shown. Naming a provider does not mean it endorses AEGIR. PelagicLabs remains responsible for its own obligations but cannot promise that an independent provider stays available.

12. Intellectual property

AEGIR's software, design, branding, original text, scoring presentation, and other content belong to PelagicLabs or its licensors. Environmental and species data remains subject to its source's licence and attribution terms.

13. Suspension and termination

You can stop using the app at any time and delete your account in the app. PelagicLabs may restrict or suspend access where reasonably needed because of a serious or repeated breach, a security risk, payment or entitlement fraud, unlawful conduct, a provider requirement, or to protect other users. Where appropriate, we will give notice and a chance to fix the problem.

Termination does not cancel amounts already due, remove the need to manage store subscriptions, or affect terms that by nature continue, such as intellectual property, legal claims, and mandatory consumer rights.

14. Conformity, warranties, and liability

PelagicLabs provides paid digital services with the conformity and remedies required by consumer law. Outside those duties, AEGIR comes with the gaps and uncertainty that are normal for forecast, sensor, network, and third-party data. We do not guarantee that data is accurate, complete, or available.

To the extent the law allows, PelagicLabs is not responsible for losses caused by treating AEGIR as a safety guarantee, ignoring official warnings, diving beyond your training or ability, unlawful access or fishing, or a third-party outage beyond our reasonable control. PelagicLabs does not exclude liability that cannot legally be excluded, including for fraud, deliberate misconduct, death or personal injury caused by negligence where the law prohibits exclusion, or mandatory consumer remedies.

15. Privacy

The AEGIR Privacy Policy explains location, Fish ID photos, accounts, purchases, on-device data, recipients, transfers, retention, and your rights.

16. Governing law and disputes

These terms are governed by Belgian law. If you are a consumer, you keep the mandatory protections of the law of the country where you live. Belgian courts have jurisdiction unless consumer law allows or requires another court, including one in your country.

Please contact us first so we can try to solve the issue. You can also use any consumer mediation, enforcement body, or court available under national or EU law.

17. Changes

We may update these terms for legal, security, provider, platform, or product reasons. The date above shows the current version. Where a material change to a paid digital service requires advance notice, consent, or a right to end the contract, we will follow that process.
